This Cookie and Privacy Policy Notice (hereinafter the Notice) contains useful information about how and for what purpose Fysica OÜ collects, processes and shares personal data (data). The Privacy Policy is based on the General Data Protection Regulation (GDPR).
The purpose of the Privacy Policy is to protect the privacy of customers in accordance with the laws of the Republic of Estonia and the legislation of the European Union.
“Personal data” is any information about an identified or identifiable natural person, such as name, address, email address and information about visits to our website, social media channels and use of our services.

Whose data does Fysica OÜ process?

Fysica OÜ processes the data of its clients and contact persons who have expressed a desire to use our services or have previously used our services.
In certain cases, we process personal data that is available from public sources.
Purposes and legal bases for processing client personal data (data)
We process the personal data of voluntary users of our marketing channels and service users and clients (including client representatives) in order to fulfill our contractual obligations as well as to provide potential clients with higher quality service and information.
If Fysica OÜ processes personal data for these purposes, the legal basis for processing is our legitimate interest in ensuring the correct and higher quality provision of our services.
We collect data from Fysica OÜ’s marketing channels (including the website) about their use and the interests of potential clients in order to better understand the real interests of our clients, provide higher quality information and improve the functionality and user-friendliness of the website.
In this case, the legal basis for processing is our legitimate interest in better understanding customer needs and providing better service.
For example, Fysica OÜ processes data on customer purchasing behavior, data on reading and opening newsletters, and data on opening advertisements, with the aim of providing the customer with their preferred offers and content.

Cookies and pixel tags and how to get rid of them

Specifically, Fysica OÜ uses:

Personal data processed by Fysica OÜ (including data)
Fysica OÜ may process the following personal data (including data):
contact details – name, email address and telephone number
data collected and generated during the performance of the contract – personal identification number, customer preferences regarding Fysica OÜ services and products, feedback on our services, information about the customer’s work, business processes or study habits and preferences.
automatically collected data – data obtained from the user’s web browser, including browser type, device type, communication language, website address from which the user arrived, which content pages were viewed, and the user’s IP address and other traffic data.
user actions in relation to Fysica OÜ emails – including data on which emails and when and how the user opened them.
other personal data – that you have made publicly available or available to us on third-party social networks such as LinkedIn, Facebook, Google Plus, Instagram, etc.
Fysica OÜ does not process special categories of personal data as the controller.
Sharing of personal data
Fysica OÜ does not transfer customer data outside the European (EU) Economic Area.
Fysica OÜ does not share customer data with third parties except under the conditions listed below. All data is used only for communication and to provide a better product or service.
We may share your personal data in the following cases:
Sending educational materials by mail – persons, institutions and organizations that mediate or provide postal services.
Debt collection – debt collection service providers, payment default registers.
State supervisory authorities and the Police.
Estonian Unemployment Insurance Fund customer data to Unemployment Insurance Fund training consultants.
Public feedback with the customer’s consent.
Security, use and storage of personal data (data)
Fysica OÜ may send customers information about its services, products, newsletters and offers if the customer has provided us with their contact details, but as long as the customer has not requested the termination of the last activities or left the newsletter recipient group.
6.1. Personal data security
The secure storage of personal data is the highest security priority of Fysica OÜ. We strive to do everything possible to prevent unauthorized access, disclosure and other unlawful processing. We protect the confidentiality and integrity of personal data and ensure access to data in accordance with applicable legislation.
We have established reasonable and sufficient organizational measures and technical and physical restrictions to protect the personal data we collect and process. The measures used depend on the type of personal data and the possible consequences of their disclosure.
Fysica OÜ has implemented the necessary technical, physical and organizational security measures to protect the customer’s personal data (data) from loss and unlawful processing.
6.2. Retention period – how long do we store personal data?
Fysica OÜ stores personal data only for as long as it is necessary to achieve the purpose for which they were collected. The retention period also depends on the need to respond to data subjects’ requests, resolve problems and comply with legal requirements for document retention.
When we no longer need personal data and the law does not require its retention, we will delete such personal data.
We may continue to use the data in question for statistical purposes, but only in pseudonymized or anonymized form.

- Client (data subject) rights
The Client has the right to access the Client’s own personal data processed by Fysica OÜ and the right to request the correction of inaccurate personal data.
If the Client has any questions about his/her rights or is of the opinion that Fysica OÜ has violated his/her rights when processing his/her personal data, he/she should definitely contact us at info@fysica.ee.
If you do not wish to receive marketing communications from Fysica OÜ, you can opt out of them by following the opt-out instructions in the footer of each marketing communication or by contacting us via our contact page.
Data subject rights
Right to rectification – is the right of the data subject to request that inaccurate personal data relating to him/her be corrected without undue delay.
Right to erasure – is the right of the data subject to request that his/her personal data be erased without undue delay, if certain additional conditions are met.
In certain cases, the data subject has the right to restrict the processing of his/her personal data.
The data subject has the right to access the personal data we store about him or her and to transmit these data to another controller, where technically feasible and where the processing is based on consent or a contract and is carried out by automated means.
The data subject has the right, on grounds relating to his or her particular situation, to object at any time to the processing of his or her personal data based on the relevant provisions of the law, including profiling based on those provisions.
Unless otherwise provided for by law, the data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or significantly affects him or her.
Where the processing of personal data is based on the data subject’s consent, the data subject has the right to withdraw this consent at any time, without affecting the lawfulness of the processing based on consent before its withdrawal.

Other provisions
Fysica OÜ reserves the right to unilaterally change the Cookie Use and Privacy Policy. The latest version of the Cookie Use and Privacy Policy is always available on this website.
This Cookie Use and Privacy Policy is subject to the laws of the Republic of Estonia. Any disputes or claims arising from the policy will be resolved in Harju County Court.
