Terms of sale and return

The owner of the online store https://fysica.ee (hereinafter referred to as the Online Store) is Fysica OÜ (registration code 16717941), located at Kivi tn 4a-13, Vasalemma alevik, Lääne-Harju parish, Harju county, 76101.

Validity of the sales contract, product and price information

The terms and conditions of sale apply when purchasing goods from the Online Store.

Information about the goods is provided in the Online Store directly next to the goods.

The prices of the products sold in the Online Store are indicated next to the products. A fee for delivering the goods is added to the price.

The delivery fee for the goods depends on the buyer’s location and the method of delivery. The delivery fee is displayed to the buyer when placing the order.

The goods are sent via DHL courier.

Ordering

To order goods, you must add the desired products to the shopping cart. To place an order, you must fill in the required data fields and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:

by bank transfer
By card payment.
The prices of goods sold in the online store are in euros. We also accept payments in euros (€).

The contract enters into force upon receipt of the amount due to the online store’s bank account.

If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will be refunded immediately, but no later than 14 days from the date of sending the notification.

Delivery

Goods are shipped to the following countries: Worldwide (except for countries under restrictions).

The shipping costs of the goods are borne by the buyer and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally reach the destination specified by the buyer within 3-14 business days from the entry into force of the sales contract. Delivery outside Estonia takes place within 21 calendar days.

In exceptional cases, the right to deliver the goods is up to 45 calendar days.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.

If the goods have been used for a purpose other than that necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the refund fee according to the decrease in the value of the goods.

To return the goods, a withdrawal form must be submitted and sent to the e-mail address info@fysica.ee no later than 14 days after receipt of the goods.

The costs of returning the goods are borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to the order (e.g. a wrong or defective item).

The buyer must return the goods within 14 days of submitting the application or provide proof that he or she has handed over the goods to the carrier of the goods within the aforementioned period.

Upon receipt of the returned goods, the Online Store will refund to the buyer all fees received from the buyer under the contract without delay, but no later than 14 days after receipt of the withdrawal form. If the order is returned in part, we will refund the postage paid for the order in proportion to the number of returned products.

The Online Store may refuse to make refunds until the item that is the subject of the contract has been returned or until the Buyer has provided evidence that the item has been returned, whichever occurs first.

If the Buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the Consumer any costs that exceed the costs associated with the standard delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the return of the item from the Buyer if the price of the item in the Online Store has been indicated significantly below the market price of the item due to an error.

Right to file a claim The Online Store is liable for any non-conformity or defect of the goods sold to the Buyer that already existed at the time of delivery of the goods and that becomes apparent within two years of the delivery of the goods to the Buyer. During the first six months of the delivery of the goods to the Buyer, it is assumed that the defect already existed at the time of delivery of the goods. It is the Online Store’s obligation to rebut this presumption. The Buyer has the right to contact the Online Store within two months of the discovery of a defect by sending an e-mail to info@fysica.ee or by calling +372 5610 3132 The Online Store is not liable for defects that have arisen after the goods have been delivered to the Buyer. If the goods purchased from the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund all fees associated with the sales contract to the Buyer. The online store shall respond to the complaint submitted by the consumer in writing or in a form that allows for written reproduction within 15 days. Processing of personal data The online store uses the personal data entered by the buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer. The online store transfers personal data to companies providing transport services in order to deliver the goods.

If the buyer has any complaints regarding the Online Store, they must be sent by e-mail to info@fysica.ee or by phone: +372 5610 3132

If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Commission. The procedural terms and conditions can be viewed and an application submitted on the website of the Consumer Disputes Commission.

The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the Commission is free of charge.

The buyer may contact the European Union’s consumer dispute resolution platform.
